Agency Adoption

In Massachusetts, only a licensed adoption agency may legally place a child for adoption.  With some exceptions, including step-parent or co-parent adoptions, adoptive parents in Massachusetts must use a private adoption agency or the Department of Children and Families ("DCF") adopt a child.

Private adoption agencies will differ in the services they offer and the fees charged.  Adoptive parents should request a schedule of fees and services prior to retaining an agency, and should expect a high degree of transparency.  Most agencies offer a full range of adoption services, including advertising, matching children/expecting parents with intended parents, coordinating home studies and post-placement visits, coordinating other interstate or international parties, and ultimately the adoption finalization hearing in court.

Most adoptions in Massachusetts follow a similar track.  First, all adoptions require either the voluntary consent of the child's biological parents or the lawful termination of parental rights by a court.  Second, all adoptions must obtain the consent and approval of DCF following a successful home study.  Finally, after the petition for adoption and all supporting paperwork is filed, including surrender or termination documentation and DCF approvals, a private adoption finalization will take place in before a judge.
