Appellate Victory! Jessica M. Walsh Thwarts Restraining Order Appeal on Behalf of Survivor

Attorney Jessica M. Walsh, in collaboration with Attorney Stephanie Holt and the Victim Rights Law Center, successfully defended the appeal of a 209A restraining order case before the Massachusetts Appeals Court. Our client, a young woman who was the target of multiple sexual assaults by her ex-boyfriend, had previously obtained a 209A restraining order in Somerville District Court. The defendant appealed, arguing he was deprived an adequate opportunity to answer the claims of the plaintiff and alleging misrepresentations and fraud on the part of the plaintiff.

Attorneys Walsh and Holt drafted and filed an appellee's brief arguing that, indeed, the defendant had an appropriate and fair hearing under the Massachusetts restraining order statute. The Appeals Court agreed, affirming the lower court’s extension of the plaintiff's restraining order and reinforcing the principle that the affidavit submitted with a plaintiff's restraining order application is sufficient to put the defendant on notice of the allegations against him or her. The Appeals Court further admonished that a restraining order extension hearing is crucial and that defendants must prepare accordingly, appear at the hearing, and put on a defense to the best of their ability.  (February 2015)
