Marital or Post-Nuptial Agreements

A marital agreement, sometimes called a post-nuptial agreement, is similar to a premarital/prenuptial agreement, but is negotiated, drafted, and signed after the parties have become married.   A marital agreement specifies how a couple’s assets and property shall be divided upon their divorce.

Because the parties are married to one another, the law places an even higher burden on the parties to treat each other with honesty, fairness, and full disclosure in negotiations.  It is critical that both parties have independent competent counsel to explain the law and advocate for his or her position.
